John M Case Co. v. Sun Belt County Juvenile Court, 597 S.W.2d 717 (Tex.Crim.App.1980). We find that there is no error in the trial court’s order denying the parents’ motions to set aside the order granting the child’s motion to transfer the case to parents for continued visitation, and also in the trial court’s order granting the motion for new hearing. The motion was granted on the basis of the court’s order denying the parents’ motions to transfer, which specifically terminated the child’s attendance schedule, and so the rights of the parents in the case remained with the trial court. Id. The record also clearly reflects that both sides of the issue had decided that it was done in a manner legally meritorious so that no one had to cross-examine the witnesses in that proceeding about the fact that the parties had reached a conclusion on the matters presented in that proceeding. The trial court’s order denying the motion to transfer and the order granting the motion for new hearing both were based on the lawfulness of the order and no evidence of that lawfulness had been presented before the trial court. On motion of the father or mother, the court shall determine whether the motion to transfer from the parents should be granted. Generally, a motion for new trial is allowed. See Tex.R.Civ.P. 49 at paragraph 2, supra.
